Information notice pursuant to and for the purposes of Art. 6, Regu... as well as Art. 13 and 23 of Legislative Decree 196/2003 (hereinafter, the Privacy Code)
Subject of the processing
The new EU Regulation on the protection of personal data No. 679/16 and Legislative Decree No. 196/03 aim to ensure that the processing of your personal data is carried out in compliance with fundamental rights and freedoms and with the dignity of individuals, with particular regard to confidentiality and personal identity. Therefore, it is our duty to inform you about our privacy policy.
DIGICORP INGEGNERIA S.R.L, with registered office in Udine, via Duino 1/1, VAT No. 01735590307 (hereinafter the “Data Controller”), in its capacity as Data Controller, represented by its legal representative Eng. Marco Cojutti, hereby informs you, pursuant to and for the purposes of Articles 13 and 14 of the GDPR and Articles 13 and 23 of the Privacy Code, that your personal data will be processed in the following ways and for the following purposes:
The Data Controller processes personal and identifying data (such as name, surname, company name, address, telephone number, and e-mail address) – hereinafter referred to as “personal data” or simply “data” – provided by you in connection with the preparation and conclusion of contracts for the services offered, following the completion of the form on the website www.digicorpingegneria.com to submit requests for information regarding the services offered, or following subscription to the “Newsletter” service.
Purposes of Processing
Your personal data are processed:
A) without your explicit consent (pursuant to Article 6(1) GDPR, as well as Article 24 of the Privacy Code) for the following service-related purposes:
- to enter into contracts for the Data Controller’s services;
- to fulfill pre-contractual, contractual, and tax obligations arising from existing relationships with you;
- to comply with obligations provided for by law, regulations, EU legislation, or orders of public authorities (for example, in matters relating to anti-money laundering);
- to exercise the Data Controller’s rights, such as the right of defense in legal proceedings;
B) only with your specific and separate consent (pursuant to Article 7 GDPR, as well as Article 23 of the Privacy Code), for the following marketing purposes:
- to send you, by e-mail, post and/or SMS and/or telephone contact, newsletters, commercial communications and/or advertising material relating to products or services offered by the Data Controller, as well as to assess the level of satisfaction with the quality of the services;
- to send you, by e-mail, post and/or SMS and/or telephone contact, commercial and/or promotional communications from third parties (for example, business partners).
Please note that if you are already our customer, we may send you commercial communications relating to products and services of the Data Controller similar to those you have already used, unless you object.
Methods of Processing
Pursuant to Article 5 of the GDPR, the processing of your Data shall be based on the principles of fairness, lawfulness, and transparency and may also be carried out through automated methods designed to store, manage, and transmit them (by means of the operations indicated in Article 4(2) of the GDPR and Article 4 of the Privacy Code), and shall be performed using suitable tools to ensure security and confidentiality through the adoption of appropriate procedures aimed at preventing the risk of loss, unauthorized access, unlawful use, and disclosure.
Your personal data are processed both in paper and digital form.
The Data Controller will process personal data for the time necessary to fulfill the purposes stated above and, in any case, for no longer than 10 years from the termination of the relationship for service purposes and for obligations imposed by law. Without the need for express consent pursuant to Article 6(1) GDPR and Article 24 of the Privacy Code, the Data Controller may communicate your data, for the purposes referred to in Article 2.A), to supervisory bodies, judicial authorities, as well as to those entities to whom disclosure is mandatory by law for the performance of the aforementioned purposes.
Your data will not be disclosed in any other way.
Data Disclosure
The data may be accessed by the Data Controller’s employees and collaborators, in their capacity as persons authorized to process and/or data processors, and may also be viewed by the external party responsible for supervising our IT system, whom our organization has appointed as an external data processor. Your data may also be disclosed to companies and/or professional firms that provide – on an outsourced basis – assistance, consultancy, or collaboration services to the Data Controller in accounting, administrative, fiscal, legal, tax, and financial matters; to public administrations for the performance of their institutional functions within the limits established by law or regulations; and to third-party service providers to whom disclosure is necessary for the performance of the services covered by the contract, should we be entrusted with an assignment requiring their involvement.
Without the need for express consent pursuant to Article 6(1) GDPR and Article 24 of the Privacy Code, the Data Controller may communicate your data, for the purposes referred to in Article 2.A), to supervisory bodies, judicial authorities, as well as to those entities to whom disclosure is mandatory by law for the performance of the aforementioned purposes.
Your data will not be disclosed in any other way.
Nature of Data Provision and Consequences of Refusal
The provision of data for the purposes referred to in point 2.A) is mandatory. In the absence of such data, we will not be able to provide you with the requested Services.
The provision of data for the purposes referred to in point 2.B) is optional. You may therefore decide not to provide any data or to subsequently withdraw consent for the processing of data already provided; in such case, you will not receive newsletters, commercial communications, or advertising material relating to the Services offered by the Data Controller.
In any case, you will continue to be entitled to the Services referred to in point 2.A).
Data Retention Period
Your personal data will be retained for the time necessary to perform the relationships existing between the parties and, in any case, for no longer than 10 years from the termination of the service provision relationship, as required by law.
Once this retention period has elapsed, the Data will be destroyed and/or deleted. The data subject may exercise their rights vis-à-vis each Data Controller.
Rights of the Data Subject
You have the right to request from the Data Controller access to the data concerning you, their rectification or erasure, the completion of incomplete data, and the restriction of processing; to receive the data in a structured, commonly used, and machine-readable format; to withdraw any consent given for the processing of your sensitive data at any time; and to object, in whole or in part, to the use of the data. You also have the right to lodge a complaint with the Supervisory Authority, as well as to exercise the other rights granted to you pursuant to Articles 15–22 of Regulation (EU) No. 679/16 and Article 7 of Legislative Decree No. 196/03.
The data subject may exercise their rights vis-à-vis each Data Controller.
Data Transfer
The data may also be disclosed in the event of the opening of foreign offices of DIGICORP INGEGNERIA S.R.L., both within and outside the EU, which, in their capacity as Joint Data Controllers, have entered into an agreement with our Company. Specific operational instructions have been issued to these offices – with particular attention to those established in non-EU countries – through contractual clauses that ensure that the data will be processed in accordance with the principles set out in Regulation (EU) No. 679/16, even in the third country of destination.

From the moment you enter your data by completing the form available on the website www.digicorpingegneria.com to request information about a service, we may use your contact details to send you commercial communications and notifications regarding new services offered by DIGICORP Ingegneria S.r.l. that we believe may be of interest to you.

Amendments
